CCI North Alberta Celebrates Historic Changes to Alberta’s Condominium Property Act

It’s a Historic Week for Alberta’s Condominium Community!

The Government of Alberta has announced that the majority of amendments to the Condominium Property Act—introduced through the Service Alberta Statutes Amendment Act, 2024—will come into force on February 15. Alongside the proclamation date, regulatory changes have now been released detailing how these long-awaited changes will be implemented.

CCI North Alberta is celebrating significant wins for the condo community. After years of advocacy, key reforms, most notably a dedicated condominium tribunal and mandatory technical audits for new builds, are becoming reality.

The new condominium tribunal is designed to provide condo owners and boards with a faster, more affordable, and more accessible way to resolve disputes. With the tribunal regulations now public, we finally have clarity on its jurisdiction and processes—bringing important certainty to how disputes will be handled once the new tribunal is operational (expected sometime later this year).

Additional notable changes coming into force include:

  • Clearer chargeback rules, including a defined process, a notice requirement, an appeal period, and confirmation that chargebacks are treated as condominium contributions.
  • Simplified voting at general meetings, with one vote per owner unless the bylaws specify otherwise (i.e. one vote per unit) or a unit-factor vote is requested.
  • Earlier owner representation on interim boards, beginning once 25% of units are sold.
  • Extended legal protections for volunteer board members acting in good faith, similar to protections provided to volunteers in the non-profit sector.
  • Clarification on insurance deductibles, confirming that a corporation does not need to submit an insurance claim in order to charge back a deductible.

These changes represent some of the most meaningful updates to Alberta condominium legislation in years.
